Lawyer Akoto Ampaw to be appointed as Special Prosecutor?

President Nana Akufo-Addo, days after assenting to the office of the special prosecutor bill is expected to name Lawyer Akoto Ampaw as Special Prosecutor in the coming weeks.

Reports indicate that he might be assisted by Lawyer Philip Addison who served as the lead counsel of the New Patriotic Party during the 2012 election petition at the Supreme Court.

Lawyer Akoto Ampaw, a partner of the law firm Akufo- Addo, Prempeh & Co, is a known human rights activist as well as an advocate of media freedom and freedom of speech.

Media sources reveal that he has accepted President Akufo-Addo’s appointment, and is currently waiting for the procedures necessary in the setting up of the newly created office.

Meanwhile, speaker of Parliament, Professor Mike Ocquaye has assured that the powers of the Special prosecutor will not clash with that of the Attorney General and his decisions will not be influenced by government. 

President Akufo-Addo assented to the Special Prosecutor bill on Tuesday, 2 January, 2018 as a fulfillment of a campaign promise in an effort to end the corruption menace in the country.

What is the Office of the Special Prosecutor Bill?

The purpose of the bill is to establish the office of the Special Prosecutor as a specialized agency to investigate specific cases of corruption involving public officers, and politically exposed persons in the performance of their functions as well as individuals in the private sector implicated in the commission of corruption and prosecute these offences on the authority of the Attorney-General.

When operational, the Special Prosecutor’s office will be independent of the Executive, which observers believe will allow it to adequately deal with corruption-related issues which have plagued past governments.

This Bill is expected to, among other things, define the modalities for the appointment and operations of the Special Prosecutor.

The office of the Special Prosecutor will have the mandate to investigate and prosecute cases of alleged corruption under the Public Procurement Act 203 Act 63 and other corruption-related offenses implicating public officers, political office holders and their accomplices in the public sector.

The Prosecutor will also be mandated to trace and recover the proceeds of corruption.
