Petitioner in Ghana Law school case unhappy with SC ruling

The Petitioner in a law suit filed against the Ghana School of Law over their mode of admission says he is unhappy with the ruling of the Supreme Court.

Professor Kwaku Asare said the court after its ruling is asking prospective students of the school to breach its own judgment which declares the writing of entrance exams into the Ghana Law School as an unconstitutional act.

The Supreme Court on Thursday June 22 ruled that it is unconstitutional for the General Legal Council (GLC) to ask applicants of the Ghana Law School to write an entrance examination and subsequently be interviewed prior to their admission. The act is in violation of Legislative Instrument 1296.

The Justices in their ruling stated, their order on cancelling the entrance examination and subsequent interview should be implemented in six months when admissions for the 2018 academic year begins. This means 2017 prospective students will still pass through the same system which has been declared unconstitutional.

Speaking to the media after the ruling, Prof. Asare, said even though he is thrilled by the judgement of the court he is confused about the court asking the public to engage in an unconstitutionality.

According to him If the process is unconstitutional then no students should be allowed to pass through it from now.
