Vacant seats controversy: Supreme Court to deliver judgement November 12

The Supreme Court has set Tuesday, November 12, 2024, to deliver its judgment on the substantive suit filed by Majority Leader and Member of Parliament for Effutu, Alexander Afenyo-Markin, against the Alban Bagbin, Speaker of Parliament, and the Attorney-General.

Counsel for the Speaker of Parliament, Thaddeus Sory, did not appear in court on Monday, November 11, also Speaker Bagbin’s statement of case was not filed.

“I quote the judgement of this matter will be delivered tomorrow, November 12, 2024,” Chief Justice Getrude Torkonoo said.

Afenyo-Markin filed a writ seeking a proper interpretation of Article 97 of the 1992 Constitution, following the Speaker’s declaration of four parliamentary seats as vacant.

The declaration came after two MPs from the New Patriotic Party (NPP) caucus and one MP from the National Democratic Congress (NDC) caucus and filed nominations to contest as independent candidates in the upcoming December 7 parliamentary election. One independent MP had also filed to contest on the ticket of the NPP.

Afenyo-Markin is also seek­ing the Supreme Court to restrain Parlia­ment from acting on the eligibility of the four MPs.
