Supreme Court to hear injunction application against Chief Justice's removal on April 2

The Supreme Court will hear the injunction application filed by the Member of Parliament for Old Tafo, Vincent Ekow Assafuah, against the processes to remove Chief Justice Gertrude Torkornoo on Wednesday, April 2, 2025.

In a writ filed at the apex court on Thursday, March 27, 2025, the MP is asking the Supreme Court to declare as null and void President John Mahama’s decision to forward petitions seeking the removal of the Chief Justice to the Council of State for consultation.

According to the plaintiff, the President is required by various provisions of the 1992 Constitution to first notify the Chief Justice about the petitions and obtain her comments and responses before forwarding them to the Council of State.

On Tuesday, the President, John Mahama announced through his Minister for Government Communications the reception of 3 petitions by the President and the forwarding of same to the Council of State to "commence the consultation process mandated by Article 146 of the 1992 Constiution"

Meanwhile, Chief Justice has requested copies of petitions filed against her before consultations between the President and Council of State under Article 146 (6).

She said that this would grant her at least seven days to respond, which could then be included in the material used for the consultations under Article 146 (6) before possibly setting up a Committee of Inquiry under Article 146 (7).

In a letter to the President and Chairman of the Council of State, the Chief Justice stressed that no decision affecting a defendant’s rights could be made without notifying the defendant of the charges and granting an opportunity to respond.
